INCLUSIÓN EN ALEMANIA: UNA VISIÓN COMPARADA DE LOS ESTADOS FEDERALES

¿Cómo ve y define Alemania el concepto de inclusión? Este concepto se basa en dos principios fundamentales, por un lado, los valores humanos y por otro, el reconocimiento de la Diversidad en la educación. Este cambio de visión de pasar de la heterogeneidad a la diversidad conlleva una transformación en la manera de afrontar este concepto. Ya no se ve a la persona con discapacidad o con diferencias importantes como grupo sino como individuo. Este cambio de visión requiere también un cambio en la estructura educativa.  Me permito hacer una breve reseña histórica, que considero fundamental para comprender la evolución hasta la situación actual de este concepto. En Alemania, históricamente las diferencias por discapacidad o por dificultades educativas han significado no sólo exclusión sino también separación en escuelas especiales, así pues, el tándem exclusión y separación han ido de la mano.  La conferencia de la Unesco en Salamanca sobre el tema “Pedagogía para las necesidades: acceso y calidad” significó el hito para poner en práctica el sistema educativo inclusivo.  El siguiente paso decisivo tuvo lugar en 2006 “la convención de las Naciones Unidas sobre los derechos humanos de las personas con discapacidad y su inclusión en el sistema educativo” principalmente en su artículo 24. Es en 2010 cuando la “Kultusministerkonferenz” (KMK) basándose en la convención de las Naciones Unidas publica un acuerdo sobre los aspectos pedagógicos y legales para la implementación de los derechos de las personas con discapacidad.  Un año más tarde ve la luz un acuerdo también de la KMK sobre la educación inclusiva en las escuelas de los niños y jóvenes con discapacidad.  En la República Federal Alemana son los Estados Federales “Länder” los que tienen competencia en materia de educación. A partir de este momento cada Land establece su propia ley, a veces más avanzada y con implementación más rápida y otras veces, al contrario.  Llegados a este punto presentaré un estudio comparativo de las leyes y de los avances más o menos rápidos en este campo de cada uno de los estados federales. La brevedad de extensión de este resumen no me permite entrar en más detalles, ya que si lo hiciera podría caer en el riesgo de sesgar algunos datos por falta de espacio.  Como ejemplo añado un mapa del país con los datos de 2017 y publicado por la Agencia Federal de Estadística. Partiendo de este estudio comparativo pretendo llegar a unas conclusiones sobre la situación actual de la inclusión en los distintos Estados Federales de Alemania.

    How does Germany see and define the concept of inclusion? This concept is based on two fundamental principles, on the one hand, human values ​​and on the other, the recognition of Diversity in education. This change of vision of moving from heterogeneity to diversity entails a transformation in the way of facing this concept. The person with disabilities or with significant differences is no longer seen as a group but as an individual. This change in vision also requires a change in the educational structure. Allow me to make a brief historical review, which I consider essential to understand the evolution to the current situation of this concept. In Germany, historical differences due to disability or educational difficulties have meant not only exclusion but also separation in special schools, thus, the tandem exclusion and separation have gone hand in hand. The Unesco conference in Salamanca on the theme "Pedagogy for needs: access and quality" was the milestone for putting the inclusive educational system into practice. The next decisive step took place in 2006 “the United Nations convention on the human rights of persons with disabilities and their inclusion in the educational system” mainly in its article 24. It is in 2010 when the “Kultusministerkonferenz” (KMK), based on the United Nations convention, publishes an agreement on the pedagogical and legal aspects for the implementation of the rights of persons with disabilities. One year later, an agreement also came to light from the KMK on inclusive education in schools for children and young people with disabilities. In the Federal Republic of Germany, it is the Federal “Länder” states that have jurisdiction over education. From this moment on, each Land establishes its own law, sometimes more advanced and with faster implementation, and other times the opposite. At this point I will present a comparative study of the laws and more or less rapid advances in this field in each of the federal states. The short length of this summary does not allow me to go into more details, since if I did, I could run the risk of skewing some data due to lack of space. As an example I add a map of the country with the data from 2017 and published by the Federal Statistical Agency. Starting from this comparative study, I intend to reach some conclusions about the current situation of inclusion in the different Federal States of Germany.
