PETIÇÕES INICIAIS CRIMINAIS: UMA ANÁLISE LINGUÍSTICO-DISCURSIVA

O estudo apresenta uma análise linguístico-discursiva em petições iniciais criminais. Neste, propomos investigar, quais estratégias argumentativas utilizadas pelos autores de três petições iniciais para convencer o juiz em absorver ou atenuar a pena dos réus. Dentre as estratégias, encontramos os marcadores discursivos, a orientação argumentativa, a narração dos fatos e a descrição dos sujeitos. Nos apoiamos teoricamente e metodologicamente em: Cabral (2011), na Teoria da Argumentação de Ducrot(1998); Portolés (2001) , dentre outros. Desse modo, o discurso constitui-se de práticas discursivas e, as estratégias argumentativas contribuem para a construção do discurso argumentativo e persuasivo dos autores das petições iniciais criminais. As petições iniciais criminais configuram como documento que introduz a defesa prévia do indivíduo e marca o início de um longo/curto processo jurídico. E durante esse período, a escolha lexical, a narração dos fatos e a argumentação do advogado são mecanismos utilizados pelos autores para atenuar a pena ou absorver o réu.

  • Abstract:

    The study presents a linguistic-discursive analysis in criminal initial petitions. In this one, we propose to investigate, which argumentative strategies used by the authors of three initial petitions to convince the judge to absorb or lessen the sentence of the defendants. Among the strategies, we find the discursive markers, the argumentative orientation, and the narration of the facts and the description of the subjects. We rely theoretically and methodologically on: Cabral (2011), on Ducrot Theory of Argumentation (1998); Portolés (2001), among others. Thus, the discourse is constituted of discursive practices and, the argumentative strategies contribute to the construction of the argumentative and persuasive discourse of the authors of the criminal initial petitions. The criminal initial petitions constitute a document that introduces the individual's prior defense and marks the beginning of a long / short legal process. And during this period, the lexical choice, the narration of the facts and the lawyer's arguments are mechanisms used by the plaintiffs to mitigate the sentence or absorb the defendant.
